Overview — This website is operated by Arteverk, doing business as Arteverk Rugs & Home ("Arteverk," "we," "us," or "our"). These Terms of Service, together with our Privacy Policy (/policies/privacy-policy) and Refund Policy (/policies/refund-policy), which are incorporated here by reference, govern your access to and use of our website and your purchases from us (the "Service"). By checking the acceptance box at checkout, creating an account, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service. Our store is hosted on Shopify Inc.

1. Eligibility

By using this site you represent that you are at least 18 years old, or that you are the age of majority in your state of residence and consent to any minor dependents using the site under your supervision. You may not use our products for any unlawful purpose or violate any laws in your jurisdiction.

2. Products and one-of-a-kind inventory

Most Arteverk rugs are one-of-a-kind: there is a single piece in stock, and once it sells it is gone. We make every effort to display colors, sizes, and detail accurately, but handmade pieces carry natural variation and your screen may render color differently than the physical rug. Dimensions are approximate and consistent with the handmade nature of the product. Prices are subject to change without notice, and we may correct errors, limit quantities, or refuse or cancel an order (including after it is placed) where information is inaccurate or where an order appears fraudulent or placed for resale.

3. Pricing, billing, and orders

You agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse, limit, or cancel any order and to limit quantities per person, household, or order. If we change or cancel an order, we will try to notify you using the contact details you provided. All payments are processed securely through Shopify Payments and our payment partners; card information is encrypted in transit.

4. Returns

Purchases are subject to our Refund Policy (/policies/refund-policy), which forms part of these Terms.

5. Intellectual property

All content on the Site — including text, product photography, graphics, logos, the "Arteverk" and "Arteverk Rugs & Home" names and marks, page layouts, and the selection and arrangement of content — is owned by or licensed to Arteverk and is protected by U.S. and international intellectual-property laws. You may not copy, reproduce, republish, distribute, or create derivative works from any Site content without our prior written permission, except that you may view and download content for your own personal, non-commercial use. Nothing in these Terms grants you any right to use our names or marks without our prior written consent.

6. Third-party tools and links

We may provide access to third-party tools (for example, reviews, advertising, and analytics services) "as is," without warranty, and our site may link to third-party websites we do not control. We are not responsible for the content, accuracy, or practices of third parties. Please review their terms and policies before transacting with them.

7. User submissions

If you send us comments, reviews, ideas, or other materials, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display them in connection with our business, without restriction or compensation. You represent that your submissions will not be unlawful, infringing, or abusive, or contain malicious code, and that you have the rights necessary to grant this license. You are solely responsible for the content and accuracy of anything you submit.

8. SMS / text messaging

If you opt in to receive text messages from us (for example, through Klaviyo at checkout or via a sign-up form), you consent to receive recurring automated marketing and transactional text messages at the mobile number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and you can request help by replying HELP. Carriers are not liable for delayed or undelivered messages. Our handling of the information you provide is described in our Privacy Policy.

9. Prohibited uses

You may not use the site or its content for any unlawful purpose; to solicit unlawful acts; to violate any law or regulation; to infringe intellectual property; to harass or discriminate; to submit false information; to upload malicious code; to collect others' personal information; to spam, phish, scrape, or crawl; for any obscene purpose; or to interfere with the site's security. We may terminate your use of the site for violating these Terms.

We do not guarantee that your use of the Service will be uninterrupted, timely, secure, or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, ARTEVERK AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR ANY PRODUCT.Where liability cannot be excluded, it is limited to the maximum extent permitted by law and, in any case, to the amount you paid for the product at issue.

11. Indemnification

You agree to indemnify and hold harmless Arteverk and its owners, employees, agents, and suppliers from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

12. Severability

If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the fullest extent permitted, and the remaining provisions will remain in effect.

13. Governing law

These Terms and any separate agreements by which we provide you Services are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, and the exclusive venue for any dispute is the state or federal courts located in Harris County, Texas.

14. Changes to these Terms

We may update these Terms from time to time. For routine changes, the revised version is effective when posted on this page, and your continued use of the Service after posting constitutes acceptance. For material changes, we will take reasonable steps to notify you and, where appropriate, ask you to accept the updated Terms before continuing to use the Service.

15. Entire agreement

These Terms, together with the policies posted on this site, constitute the entire agreement between you and Arteverk and supersede any prior agreements. You can review the most current version at any time on this page.
